Title : Investigator/Clery Act Coordinator

Description : Hartwick College seeks applications for the full-time position of Investigator/Clery Act Coordinator. Reporting to the Vice President for Human Resources and Compliance, the Investigator/Clery Act Coordinator will serve as both an investigator of allegations of sex-based and non-sex-based discrimination, and manage the Jeanne Clery Act Compliance program for the College.

The Investigator plays a critical role in addressing and investigating reports of sex or sex-based discrimination and all other forms of discrimination, harassment, and retaliation prohibited by law or by college policy(s). The Investigator gathers relevant facts and evidence to the extent it is reasonably possible and creates a summary report of their fact-finding and maintains an electronic file of all relevant evidence. Additionally, the investigator will analyze their fact-finding and relevant evidence to summarize information pertaining to credibility such as if and when information is corroborated or contested.

The Clery Act Coordinator ensures Hartwick College meets the standards and institutional obligations under the Jeanne Clery Act (Clery Act). The Coordinator will collaborate with various offices across campus to develop policies, procedures, activities, and protocols to ensure the College is in compliance with all provisions and citations of the Clery Act and the Violence Against Women’s Act (VAWA).

Investigator Responsibilities :
  • Conduct prompt and thorough investigations into allegations of sexual harassment, sexual assault, relationship violence, sex and gender-based discrimination, and other Title IX and discriminatory harassment in accordance with Hartwick College policies and procedures.
  • Collect, maintain, and review evidence, including documents, emails, witness statements, and other relevant information to determine the credibility of allegations and the facts surrounding the incident.
  • Conduct interviews with complainants, respondents, witnesses, and other relevant parties to gather information and assess the credibility of the involved parties.
  • Prepare detailed investigative reports which include a documentation and summary of factual findings, evidence, and an analytical summary of the relevant facts and evidence.
  • Ensure compliance with Title IX regulations and other applicable laws (Title VI, Title VII, ADA, Clery Act, VAWA, NYSED 129A&B), and institutional policies and procedures throughout the investigation process.
  • Collaborate with Human Resources and Compliance, Academic Affairs, Student Experience, Athletics, and others as necessary during the investigation process.
  • Maintain strict confidentiality throughout the investigation process to protect the privacy of individuals involved and ensure a fair and impartial resolution.
  • Assist in the development and delivery of training programs and educational materials related to Title IX compliance and discrimination and harassment prevention for students, faculty, and staff.
  • Comply with all applicable College, Federal, State, local nondiscrimination laws, rules, and regulations.
  • Comport themselves professionally at all times, both on and off campus.
Clery Act Coordinator Responsibilities:
  • Coordinate the College’s Clery Compliance Program.
  • Serve as the College’s designated “Campus Safety Survey Administrator” as defined by the U.S. Department of Education (the Department) and submit annual crime and fire statistics to the Department, as required.
  • Prepare, publish, and distribute the Annual Security and Fire Safety Report (ASFR).
  • Develop, audit, publish, and ensure compliance with the requirements for the Clery Act (including the Violence Against Women Act), the Drug-Free Schools and Communities Act, and the fire safety requirements of the Higher Education Opportunity Act.
  • Monitor, update, and implement institutional Clery Act policies and procedures, and formulate changes to policies and procedures based on best practices and applicable law in conjunction with appropriate offices.
  • Collaborate with various offices (e.g., Title IX, Campus Safety, Student Experience) to ensure proper classification of incident reports and serve as the intuitional custodian of all Clery Act compliance records by maintaining databases to certify and preserve the accuracy and accessibility of information.
  • Identify, train, support, and maintain a current list of all Campus Security Authorities across the institution.
  • Train key College stakeholders about compliance requirements and responsibilities in accordance with the Clery Act and designated Campus Security Authorities.
Qualifications : Minimum requirements for this position are a Bachelor’s degree from an accredited college or university in a related field such as law, criminal justice, social work, or a relevant discipline. Prior experience conducting investigations, preferably in a higher education setting or related field is required, as is experience with Clery or other pertinent compliance responsibilities.
  • Knowledge of Title IX regulations, federal and state laws related to discrimination and harassment, and best practices in conducting investigations.
  • Knowledge of Title VI, Title VII, ADA, Clery Act, VAWA, and NYSED 129A&B.
  • Excellent writing and reasoning skills.
  • Strong interpersonal and communication skills, with the ability to interview individuals sensitively and impartially.
  • Excellent organizational skills and attention to detail, with the ability to manage multiple cases simultaneously.
  • Ability to maintain neutrality and objectivity throughout the investigation process.
  • Commitment to diversity, equity, and inclusion principles.
  • Certification or training in Title IX investigations is preferred.
  • Clery Act training and experience with the Violence Against Women Act (VAWA) and Title IX.
  • Experience working with an institution of Higher Education with Clery compliance responsibilities.
This is a full-time, benefits-eligible position.

Salary range : $65,000 - $72,000.
