We are seeking to hire an attorney with 6 or more years of wage and hour experience to lead teams in litigating class and collective action wage theft cases.

About Getman, Sweeney & Dunn

We believe that wage theft is a social injustice and advocate vigorously for working people. For over 25 years, the Firm has been representing workers only, primarily in a wage and hour litigation practice, including overtime pay, minimum wage, and other wage theft cases. We are proud to handle cases for a sizable low- and middle-income population as well as undocumented and documented immigrants. We litigate class and collective actions throughout the U.S, and some individual actions. While most of our litigation is in federal court, we also litigate in state court and in arbitration. Teamwork is fundamental to what we do and what helps to make us successful.

About You

Applicants need a deep commitment to righting wrongs, substantial experience in complex federal and state litigation, including class and collective actions, extensive knowledge of wage and hour laws, the ability to supervise and mentor a litigation team, strong research skills, and excellent oral and written communication skills. Superior interpersonal skills are also required to work with our team and our diverse clients. Spanish fluency or fluency in another language is highly desirable but is not required for consideration. You must be admitted to practice law in New York or another state court and in good standing or about to be admitted.

What You Will Do

Responsibilities include but are not limited to:

· Lead and supervise case teams, composed of at least the lead attorney, one associate attorney, one paralegal, and one data analyst;

· Develop legal theories and litigation strategies to successfully lead complex cases to a successful conclusion and maximize recovery for our clients;

· Develop and maintain client relationships;

· Conduct and oversee interviews of clients and potential witnesses;

· Manage discovery (issue discovery demands, take and defend depositions, move to compel discovery, oppose defendants’ unreasonable requests, and ensure discovery is complete);

· Lead and manage drafting of court and arbitration filings, which includes: complaints, collective and class action motions, summary judgment, and pre-trial filings;

· Evaluate new cases;

· Lead mediation process, which includes overseeing damage calculations, mediation statement drafting, and risk assessment;

· Collaborate with associates, paralegals, and data scientists on data discovery;

· Lead oral arguments;

· Identify and advocate for ways to expand FLSA & state wage/hour laws.

Compensation & Benefits

Compensation includes a salary range of $115,000 to $125,000 depending on relevant experience, bonuses in profitable years, vacation and sick pay, health insurance, 401k, 18 weeks of parental leave for the birth or adoption of a child, and other benefits. We have a reasonable 1,400 billable hour requirement. We are family-friendly and thrive on a collegial, team-based litigation approach.
